1.1.“Platform” means the web-based spectral data upload and distribution platform operated and provided by the Platform Provider to which Data Providers may contribute Raw Data and on which Data Users may search, access, view and/or download Processed Data. The Platform features search capabilities, visualization tools, and download functionalities, and tracks Processed Data usage, notifies Data Providers of Processed Data downloads, and maintains records of scientific outcomes.
1.2."Platform Use Agreement" means the binding use agreement concluded between the User and the Platform Provider which is governed exclusively by the Terms.
1.3."User" means any registered user of the Platform, regardless of whether they act as Data Provider, Data User, or both.
1.4."Data Provider" means researchers (principal investigators = PI) operating FloX Instruments who register with the Platform to Contribute Raw Data.
1.5."Data User" means researchers and organizations who register with the Platform to search, access, view and/or download Processed Data for scientific analysis, satellite validation, model development, and educational purposes.
1.6.“Raw Data” means raw spectral/hyperspectral data measured by FloX Instruments consisting of comprehensive essential metadata including FloX Instrument characteristics, calibration history, vegetation type, site conditions and description, and meteorological data.
1.7.“Contribute/Contributing Raw Data” means to contribute Raw Data to the Platform either automatically through equipped data transfer modules or manually via the Platform’s Data interface.
1.8.“Processed Data” means Raw Data processed by Platform Provider by using standardized processing algorithms to generate harmonized/standardized data including solar irradiance, upwelling radiance, reflectance, vegetation indices, and sun-induced fluorescence with associated uncertainty estimates. Processing algorithms will be documented and version-controlled to ensure reproducibility.
1.9.“FloX” or “FloX Instrument” means the Fluorescence Box, a product developed, manufactured, offered and distributed by the Platform Provider. The FloX is an unique instrument which provides high-quality spectral measurements of solar irradiance, upwelling radiance, surface reflectance, and sun-induced chlorophyll fluorescence and by this enables the continuous observation of chlorophyll fluorescence. It measures spectral data of extremely high resolution, yet is built to withstand the hazards of a permanent outdoor installation.
1.10.“INSIF” means the International Network of Sun-Induced Chlorophyll Fluorescence, a globally distributed network of FloX Instruments.
1.11.“Commercial Use” means any use of Raw Data or Processed Data that is intended for, directed towards, or results in a commercial advantage or monetary compensation. This includes, without limitation: use of Raw Data or Processed Data in products or services offered for sale or against payment; use of Raw Data or Processed Data in research or development activities conducted for or funded by a commercial entity, except where such funding is provided solely to support independent academic research; use of Raw Data or Processed Data in consultancy, contract research, or other fee-based activities; use of Raw Data or Processed Data for the purpose of obtaining patents or other intellectual property rights, where the of Raw Data or Processed Data form a substantial part of the inventive concept; and (e) any use of Raw Data or Processed Data that contributes to revenue generation, cost savings, competitive advantage, or other commercial benefit.
1.12.“Non-Commercial Use” means any use of Raw Data or Processed Data that is not Commercial Use. Non-Commercial Use includes, in particular: use of Raw Data or Processed Data for purely academic or educational purposes; use of Raw Data or Processed Data within publicly funded, non-profit research projects, provided that the results are not intended for commercial exploitation; and personal, private, or recreational use of Raw Data or Processed Data without monetary or competitive intent.
2.1.These Terms and Conditions (“Terms”) govern the contractual relationship between each registered user of the INSIF online platform (“Platform”) operated and provided by JB Hyperspectral Devices GmbH, Am Botanischen Garten 33, 40225 Düsseldorf, Germany (“Platform Provider”) and shall apply to all services made available via the Platform as well as to any use of any such services by any User. By completing the registration process and accepting these Terms, the User enters into a binding user agreement for the use of the Platform with the Platform Provider.
2.2.The contractual relationship between the User and the Platform Provider, the User’s access to and use of the Platform, as well as the provision and operation of the Platform by the Platform Provider shall be governed exclusively by these Terms. Any general terms and conditions or other contractual provisions of the User shall not apply, even if the Platform Provider does not expressly object to them.
2.3.The Platform Provider owns and retains all right, title, and interest in and to the Platform, including all related intellectual property rights. Nothing in these Terms shall be construed as transferring any ownership or intellectual property rights in the Platform to the User.
3.1.The Platform forms an integral part of the DEFLOX CCN5 project which aims to establish a comprehensive infrastructure for long-term monitoring of Sun-Induced Chlorophyll Fluorescence (SIF) through INSIF. For this purpose, the DEFLOX CCN5 project aims to establish a coordinated network of FloX Instruments deployed globally across diverse ecosystem types and climatic zones in order to provide centralized data storage and processing capabilities.
3.2.The Platform’s mission is to collect, process, and distribute high-quality spectral data from FloX instruments globally, emphasizing standardized processing, quality control, and support for scientific research.
3.3.The Platform shall facilitate open access to Processed Data, exchange and collaborative analysis of Processed Data and by this shall support scientific research while maintaining appropriate oversight mechanisms that respect Data Provider contributions and intellectual property.
3.4.The Platform provides and maintains downloads a registry of scientific outcomes, publications, and presentations resulting from Processed Data usage, for comprehensive tracking of Processed Data.
3.5.In particular, but not exclusively, the Platform is intended for the following categories of Users: research institutions, academic scientists, students, space agencies, industry researchers.
3.6.The Platform allows Data Providers to Contribute Raw Data as well as it allows Users to search, view and download Processed Data subject to the provisions of these Terms.
3.7.Registration and the use of the Platform are free of charge. Users may act as Data Providers, Data Users, or both.
4.1.All Users need to register with the Platform regardless of whether they act as Data Provider, Data User, or both.
4.2.During the registration process Users must provide their first and surname as well as their e-mail-address. Users may also, on a voluntary basis, provide the following information: name of institution, address, profession and intended use. The Platform Provider reserves the right to request additional personal data and/or other data or information during the registration process.
4.3.Users may indicate whether they intent to use the Platform as Data Provider, Data User, or both. However, an indication as “Data Provider” does not constitute any obligation to contribute Raw Data at all or to contribute Raw Data in any particular quantity, frequency, or regularity. Users who intend to use the Platform solely as Data User or both as Data Provider and Data User may provide information as to their intended use of Processed Data.
4.4.An auto-generated username and a password chosen by the User constitute the login credentials for accessing the User account and using the Platform. Users must keep their login credentials confidential and protect them against any unauthorized access by third parties.
4.5.Registration requires acceptance of these Terms and the Privacy Policy by clicking the acceptance checkboxes.
4.6.As the Platform is accessible to Users worldwide, personal data of Users may also be transferred to Users located in countries outside the European Union and the European Economic Area. The following risks may exist when personal data of Users is transferred to Users located in countries outside the European Union and the European Economic Area:
4.6.1.Personal data could possibly be passed on to third parties beyond the actual purpose of using Processed Data by Data Users or of informing Data Providers of the identity of Data Users, and such third parties could use the personal data for other purposes.
4.6.2.Users may not be able to effectively assert and/or enforce data protection rights to information and other rights of data subjects.
4.6.3.There may be a higher probability that personal data may be processed incorrectly because the technical and organizational measures for data processing to protect personal data may not fully meet the requirements of the GDPR in terms of quantity and/or quality.
4.6.4.There may be a risk that state authorities in countries outside the European Union and the European Economic Area will request information from Users as the recipients of the personal data, making it easier for state authorities to obtain personal data than it would be for state authorities in the European Union and the European Economic Area. It would probably be difficult or even practically impossible for Users to obtain legal protection against this.
4.7.When registering for the Platform Users have to provide their explicit legal consent with the transfer and processing of their personal data to other Users located in countries outside the European Union and the European Economic Area. Users can revoke this consent at any time by sending an e-mail to the Platform Provider at insif@brockmann-consult.de. After a revocation it is no longer possible for a User to use the Platform. In such cases, the Platform Provider may terminate the Platform Use Agreement with immediate effect for cause according to Section 11 of these Terms & Conditions.
4.8.Registration requires the truthful, accurate and complete submission of the requested information. Users must keep their account information accurate and up to date at any time while registered. Registration is not possible without completing all mandatory fields. Any failure to comply with the obligation to provide truthful information only, and/or with the obligation to update such information in the event of any changes, shall entitle the Platform Provider to terminate the Platform Use Agreement for cause in accordance with Sec.
4.9.Once the registration process is completed the User will receive a confirmation e-mail sent to the User’s e-mail address. The confirmation e-mail provides for a confirmation link which must be clicked by the User in order to finalize the registration.
4.10.Users may deregister from the Platform at any time without providing reasons. Data Providers acknowledge that upon deregistration they have no right to request deletion of Raw Data they previously contributed to the Platform or of Processed Data derived from such Raw Data or to require Data Users who downloaded such Raw Data and/or Processed Data to delete it. Mandatory legal deletion obligations that may apply under data protection laws regarding personal data shall remain unaffected.
5.1.Data Providers shall provide Raw Data as completely and comprehensively as possible. In particular, but not exclusively, the following metadata and additional information, where available, should be attached to the Raw Data:
a.Institute, PI name/names, contact/s. Site name, target, installation place, coordinates, topography, installation date, set up information (distance from the canopy and orientation), FloX serial number and last calibration;
b.eventual other network available at the site, funding scheme
5.2.The metadata and additional data to be provided where possible are displayed in a dedicated section of the Platform. The Platform Provider reserves the right to expand and/or modify the type and scope of the metadata and additional data to be provided where possible from time to time. Data Providers can find the then-current version in the dedicated section of the Platform.
5.3.Data Providers shall maintain scientific oversight of their Contributed Raw Data at any time.
5.4.Data Providers accept that by Contributing Raw Data, such Raw Data will be publicly available and that the Platform does not provide for an embargo period functionality.
5.5.By Contributing Raw Data, Data Providers grant the Platform Provider the right to process such Raw Data. Furthermore, Data Providers grant the Platform Provider and all Users a simple, i.e. non-exclusive, non-transferable and non-sublicensable right to access, use, distribute and redistribute the Raw Data for non-commercial purposes as Processed Data, subject to the condition that
a.the Data Providers retain full ownership and control of the Contributed Raw Data;
b.any non-commercial use is accompanied by proper citation according to the citation guidelines referred to in Appendix B to these Terms; and
c.any commercial use is subject to the Data Provider’s prior approval in writing and shall comply with any further terms and conditions, if any, that may apply to such commercial use.
5.6.By Contributing Raw Data, Data Providers confirm and warrant that:
a.the Raw Data represent genuine and unmanipulated results solely generated from operating FloX Instruments;
b.all measurements and Raw Data collection were performed diligently, in accordance with the current state of scientific knowledge and in compliance with the applicable operating instructions and the standardized calibration plan of the FloX Instrument; and
c.they hold all rights necessary to Contribute Raw Data to the Platform.
5.7.Sec. 5.4. notwithstanding Data Providers do not provide any warranty, guarantee or liability for the correctness, accuracy, reliability, quality, completeness or suitability of the Raw Data for any particular purpose.
6.1.Data Users may search for Processed Data by using the Platform’s search capabilities. Once a potentially suitable set of Processed Data has been identified, certain corresponding metadata and information about the Processed Data and the Data Provider of the corresponding Raw Data may be viewed in advance via the Platform’s visualization tools before a download is initiated.
6.2.Prior to every download of Processed Data, a pop-up window will require the Data User to give explicit consent ( opt-in) that the Data Provider which has contributed the Raw Data from which the Processed Data has been derived will be notified of the download of said Processed Data including the exact timestamp of the download as well as of the identity, institutional affiliation (if provided), and contact details of the Data User. Furthermore, the Data User must explicitly
a.confirm to comply with the citation guidelines referred to in Appendix B to these Terms in case of any non-commercial use of the Processed Data;
b.confirm that any commercial use of the Processed Data is subject to the Data Provider’s prior approval in writing and shall comply with any further terms and conditions, if any, that may apply to such commercial use; and
c.consent to the tracking and storage of the download of Processed Data by the Platform Provider for statistical and analytical purposes.
6.3.Only upon such active consent will the download be permitted. The Platform Provider will transmit the identity of the Data User, their institution (if provided), and the timestamp of the download to the respective Data Provider.
7.1.All Data Users acknowledge and agree that the use of any Processed Data is entirely at their own risk and responsibility. In particular, they acknowledge and agree that
a.any Processed Data is provided "AS IS" without warranties of any kind, including accuracy, completeness, or fitness for particular purpose;
b.Quality control procedures do not eliminate possibility of errors or artifacts in data;
c.Data Users are responsible for verifying data suitability and quality for their specific applications;
d.Instrument calibration, environmental conditions, and measurement geometry affect data quality;
e.Data Users shall contact Data Providers for additional site information, metadata, and guidance on data interpretation;
f.the Platform Provider makes no guarantee of data availability, uptime, or continued service;
g.Raw and/or Processed Data may be updated or reprocessed and that version control is Data User’s responsibility; and
h.The Platform Provider shall not be liable for decisions, analyses, or publications based on Raw and/or Processed Data.
7.2.All Data Users acknowledge and agree that the use of any Processed Data is subject to the condition that
a.the Data Providers retain full ownership and control of the Contributed Raw Data;
b.any non-commercial use is accompanied by proper citation according to the citation guidelines referred to in Appendix B to these Terms; and
c.any commercial use is subject to the Data Provider’s prior approval in writing and shall comply with any further terms and conditions, if any, that may apply.
7.3.All Data Users acknowledge the importance of contacting Data Providers for proper Data interpretation. Data Users shall contact Data Providers directly to: obtain additional site information and metadata not captured in standardized fields; understand site-specific measurement conditions and potential data limitations; clarify appropriate use cases and analysis methods for specific datasets; report potential data quality issues or anomalies; discuss potential collaboration or co-authorship for significant studies; acknowledge data provider expertise and local knowledge.
7.4.Users undertake to use the Platform as well as any Raw Data and Processed Data only in compliance with all applicable laws, scientific standards, and ethical guidelines.
7.5.Users shall not:
a.license, sublicense, sell, resell, transfer, assign, distribute, or otherwise commercially exploit the Platform or parts thereof;
b.modify, adapt, or create derivative works based on the Platform or parts thereof; or
c.reverse engineer, decompile, or disassemble the Platform or parts thereof.
8.1.The Platform Provider does not warrant or guarantee:
a.the accuracy, quality, reliability, completeness, authenticity or suitability of any Raw Data and/or Processed Data;
b.the scientific correctness of measurements or methodologies applied by Data Providers;
c.any User’s compliance with these Terms, in particular any Data User’s compliance with the obligations according to Sec. 7.2.
8.2.The Platform Provider expressly disclaims any liability for damages, losses, or claims arising out of or relating to the use or interpretation of, or reliance on Raw Data and/or Processed Data.
8.3.Data Providers acknowledge and agree that Data User’s compliance with the obligations according to Sec. 7.2. may not be enforceable at all and that the Platform Provider expressly disclaims any liability for damages, losses, or claims arising out of or relating to any noncompliance of Data Users with the obligations according to Sec. 7.2.
9.1.The Platform Provider does not assume any guarantee for the uninterrupted availability or accessibility of the Platform, any parts of the Platform, or any services provided through the Platform. In particular, the Platform Provider does not guarantee that such availability and/or accessibility will exist during specific periods of time or at certain hours, nor does the Platform Provider warrant any minimum level of availability or accessibility.
9.2.The Platform Provider may interrupt or restrict the availability and/or accessibility of the Platform at any time, including, but not limited to, in cases of IT security incidents, cyber-attacks, overload of servers or other IT infrastructure, urgent maintenance work, technical malfunctions, or other operational or security-related reasons.
9.3.The Platform Provider may modify, limit, update, or enhance the Platform at any time and may interrupt or restrict the availability and/or accessibility of the Platform for such purpose.
9.4.Where the cause of an interruption or restriction is foreseeable and can be planned in advance, the Platform Provider shall provide prior notice within a reasonable time frame.
9.5.The Platform Provider expressly disclaims any liability for damages, losses, or claims arising out of or relating to the inability of the User to access or use the Platform or any parts of the Platform or any services provided via the platform or any Data.
10.1.The Platform Provider shall only be liable for any damage incurred by the User in accordance with the following provisions: The Platform Provider shall be liable according to the legal provisions
a.for death, injury to body and health which are caused by a culpable breach of duty by the Platform Provider, its legal representatives or its vicarious agents;
b.for other damages arising from any deliberate or grossly negligent breach of duty as well as fraudulent intent by the Platform Provider, its legal representatives or its vicarious agents;
c.within the limits of the German Product Liability Act.
10.2.The Platform Provider shall moreover be liable for breach of any guarantee assumed.
10.3.The Platform Provider’s liability arising from culpable, i.e. at least negligent but not deliberate or grossly negligent breach of a material contractual obligation whose fulfilment is essential for the proper performance of the Platform Use Agreement and on whose proper fulfilment the User may rely (material duty) shall be limited to the typical foreseeable damage.
10.4.Any liability of the Platform Provider exceeding the scope of the foregoing provisions is excluded, irrespective of the legal nature and/or basis of the claims asserted against the Platform Provider.
10.5.To the extent that liability is excluded or limited under these Terms, such exclusion or limitation shall also apply to the personal liability of the Platform Provider’s employees, staff members, agents, corporate bodies, and vicarious agents.
10.6.Sec. 8 and Sec. 9 shall remain unaffected by this Sec. 10.
11.1.The Platform Provider may temporarily block or restrict User’s access to the Platform terminate the Platform Use Agreement and block access to the Platform for good cause, including but not limited to:
a.Failure to comply with the obligation to provide truthful information only, and/or with the obligation to update such information in the event of any changes;
b.failure to comply with the citation guidelines referred to in Appendix B to these Terms in case of any non-commercial use of the Processed Data;
c.any commercial use of the Processed Data without the Data Provider’s prior approval in writing and/or non-compliance with any further terms and conditions, if any, that may apply to such commercial use;
d.any other infringement of these Terms;
e.misuse of the Platform;
f.contributing unlawful, inappropriate or fraudulent data;
g.security risks or technical issues requiring immediate action.
h.revocation of consent with the transfer and processing of User’s personal data to other Users located in countries outside the European Union and the European Economic Area (see Sec. 4.6. and 4.7. above).
11.2.The Platform Provider may terminate the Platform Use Agreement if, after committing one of the above-mentioned violations and receiving a warning, the User again commits the same or another of the above-mentioned violations, or if there is otherwise good cause. The Platform Provider may terminate the Platform Use Agreement immediately and without prior warning if the User commits a serious violation.
11.3.Termination will be preceded by a reasonable prior notice, unless immediate termination is required due to the severity of the breach.
The Platform Provider processes personal data of Users as described in the Platform’s Privacy Policy.
13.1.These Terms may be amended with four (4) weeks’ prior notice, provided that the amendment is reasonable for the Users, taking into account the interests of both contractual parties. The amendment will be announced by email to the last email address provided by each User. If the User does not object to the amendment within the specified period, the amendment shall be deemed approved. Users will be informed of this consequence in the amendment notice.
13.2.If, however, the User objects in due time, the Platform Use Agreement will continue under the Terms in their previous version. In this case, the Platform Provider reserves the right to terminate the Platform Use Agreement.
14.1.These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
14.2.The exclusive place of jurisdiction for all disputes arising out of or in connection with these GTC shall be Düsseldorf, Germany, unless mandatory jurisdiction rules apply.
Data providers contributing to the INSIF network are required to supply metadata for each measurement site. The following table shows the required metadata fields with an example from FloX instrument JB-010-ES deployed at UFOPA Farm, Santarém, Brazil:

All data downloaded from the INSIF platform must be properly cited in any publication, presentation, report, or other form of dissemination. The citation requirements are as follows:
Mandatory Citation Elements
When using INSIF data in publications, users must:
Acknowledge the INSIF platform – Clearly state that the data were obtained from the INSIF (International Network of Sun-Induced chlorophyll Fluorescence) platform.
Cite the Principal Investigator (PI) – Include the name of the PI responsible for the FloX instrument from which the data originated. This information is provided on the instrument's landing page within the platform.
Acknowledge funding sources – If funding acknowledgments are specified on the instrument's landing page, these must be included in the acknowledgment section of the publication.
Collaboration with Principal Investigators
Users are strongly encouraged to contact the PI of the instrument(s) whose data they are using to discuss the research and explore potential collaboration opportunities. Depending on the extent and nature of data use, it may be appropriate to invite the PI as a co-author of the publication. This practice promotes scientific collaboration and ensures proper recognition of the efforts involved in data collection and quality control.
Recommended Citation Format
The following format is recommended for citing INSIF data:
Data citation: [PI Name(s)], [Year]. [Dataset title or description]. Downloaded from the INSIF platform (https://[platform URL]), [access date].
Acknowledgment section: "Data used in this study were obtained from the INSIF (International Network of Sun-Induced chlorophyll Fluorescence) platform. We acknowledge [PI Name] for providing the [instrument name/location] measurements. [Include specific funding acknowledgment text as provided on the instrument landing page]."
Compliance
Failure to properly cite and acknowledge INSIF data according to these requirements may result in temporarily blocked or restricted access to the platform or future data downloads from the platform or in the termination of the platform use agreement by the platform provider subject to the terms and conditions of the INSIF platform.
